Options, Protection, and Claims
Whistleblowers throughout the United States are afforded protections and choices under a multitude of federal statutes, state statutes, and common law doctrines. There are over 50 federal statutes that provide whistleblowers protection from retaliation, and several provide aveues for whistleblowers to directly benefit from their disclosures of fraud, illegal conduct, and wrongful behavior. Several states also offer similar protections. Finally, many of the states that do not offer statutory protection use the common law doctrine of wrongful discharge in violation of public policy to protect whistleblowers. Several of the most well known protections and options for whistleblowers are derived from the Dodd-Frank Act, the Sarbanes-Oxley Act (SOX), and the False Claims Act (FCA).
